1. BIDDER REGISTRATION:
The auction is open to the public and all
bidders are required to register with the auctioneer to receive a bidder’s
card. Bidder Registration will begin at 8:00 A.M. on Auction Day. In order
to obtain a Bidder’s Card, a refundable deposit in the amount of $100.00
must be given at the time of registration together with a valid Driver’s
License which provides the Bidder’s full name and address.
2. FORM OF AUCTION:
All inventory offered for sale at this auction
is the property of The Miami-Dade County School Board and will be sold to
the highest bidder(s) at absolute auction. All sales are final at the fall
of the Auctioneer’s gavel. Each lot will be offered and sold in "As-Is"
condition without warranty or representation of any kind. Inspection of the
inventory and determination of its condition is the sole responsibility of
the Bidders. National Auction Company and the Seller, The Miami-Dade County
School Board will NOT be responsible for correct description (s),
genuineness, authenticity or defect in any lot and make no warranty in
connection therewith. No sale (s) will be set aside or allowance made
because of any imperfection not noted and there will be no deductions for
damaged articles.
3. METHOD OF SALE:
a. The order of sale and increments of bids will be at the discretion of the
Auctioneer.
b. The Seller reserves the right to add or delete any item(s) from the
auction.
c. In the event there are disputes between bidders, the decision made by the
Auctioneer will be considered final.
d. The auction will be audio taped to provide a record of the event which is
the sole property of National Auction Company and The Miami-Dade County
School Board.
e. The Auctioneer reserves the right to offer the assets in bulk or by the
piece.
f. Purchasers are not permitted to resell items purchased during the auction
to third parties or reassign auction clerking tickets to other bidders.
4. BUYER’S PREMIUM:
A 10% Buyer’s Premium will be added to all top bid prices and
included in the total purchase price.

5. FLORIDA SALES TAX:
Florida Sales Tax will be charged in
accordance with the rules of the Florida Department of Revenue in the amount
of 7%. Florida dealers with resale numbers must bring a certificate to the
auction which must be presented at the time of bidder registration.
6. DEPOSITS:
A deposit in the amount of 25% must be paid
on all inventory purchased before leaving the auction site. Additional
deposits may be required during the conduct of the auction as established by
the Auctioneer. All deposits must be made in the form of cash or cashier’s
check made payable to the Miami-Dade County School Board.
In the event any bidder who makes a deposit and fails to pay the balance
due, the deposit given will be forfeited at the discretion of The Miami-Dade
County School Board.
7. SETTLEMENT:
Final payment (s) for inventory purchased must be made no later than
12:00 Noon, Friday, February
17, 2012 and prior to removal of any portion of
the items purchased. All payments must be in the form of cash or cashier’s
check made payable to The Miami-Dade County School Board. Payments will be
accepted on auction day at 4300 SW 74 Avenue, Miami, Florida until 3:30 P.M.
After the day of the auction, only money orders or certified checks are the
form of payment accepted at 7001 SW 4 Street, Miami, Florida.
8.
MOTOR VEHICLE CERTIFICATES OF TITLE:
Upon receipt of final payment (s) and with paid receipt (s), Motor
Vehicle Certificates of Title will be made available.
9. INTERNAL REVENUE SERVICE NOTICE:
Any individual who makes a payment in the form of cash in an amount
which exceeds $10,000.00 will be required to provide information requested
and sign IRS Form 8300.
10. REMOVAL:
a. No inventory/purchases can be removed until the auction has been
completed.
b. Purchases cannot be removed without paid receipts.
c. For vehicles that are to be removed by transport or tow trucks, Purchasers
are reminded to provide copies of paid receipts to the transport/tow truck
drivers as vehicles cannot be released without proof of payment and
authority to release them to the transport/tow truck company.
d. Inventory/purchases must be removed from the property of The Miami-Dade
County School Board no later than Monday, February 20, 2012 by 3:00 P.M.
e. Failure to remove inventory/purchases within the time specified will
result in forfeiture of all deposits. Since forfeiture shall constitute a
breach of contract and all purchasers remain liable and at risk for any
loss, expense and damages arising from said default (s) if it necessitates
reselling the inventory to another purchaser(s).
11. COMPLIANCE:
All persons acknowledge the preliminary reading of these terms and
conditions precedent to the commencement of the auction and agree to comply
with same. No employee of National Auction Company, Inc. is authorized to
alter these terms and conditions.
12. ANNOUNCEMENTS:
All announcements made Auction Day take precedence over all
previously printed materials or statements made. All information was derived
from sources believed to be correct but is not guaranteed.
13.
DIRECTIONS:
Take State Road 826 (Palmetto Expressway) to
Bird Road (SW 40th Street). Exit east and continue to SW 74th Avenue and
turn right. Continue on SW 74th Avenue to auction site on east side of the
street. Watch for auction signs.
