TIMED AUCTION OF SURPLUS SCHOOL BUSES & VEHICLES

January 2024

1. SCOPE:

  • The School Board of Broward County will conduct a public auction of District Owned School Buses, Vehicles, Trailers, and Equipment that have been declared surplus to The District's needs.

2. AUCTION DATE

  • This auction will be a Timed Bid On-Line Auction. Bids will be received at www.natlauction.com and conducted on Proxibid.com.
  • Registration for the auction will be through Proxibid.com, and bidders will be required to provide credit card information for verification only.
  • The auction will open on January 19, 2024, at 3:00 P.M. and end on January 25, 2024, with lots beginning to close at 3:00 P.M.
  • The auction website will use staggered closing times, but all bids will close on January 25, 2024.

3. REPORTING OF BIDS

  • All High Bids will be reported to The School Board of Broward County. Bids received after published closing times will not be accepted except those that fall under the Extensions of Bid conditions described in the following paragraph.
  • If a bid or bids are made during the last two minutes of an auction, the ending time for the auction will be extended for an additional two minutes. Extensions will continue until no further bids are received within the last two minutes of the auction.
  • National Auction Company and The School Board of Broward County have no control over this process.

4. FORM OF AUCTION

  • All Vehicles, Trailers, and Equipment included in this Timed-Bid Auction are offered Subject to the Confirmation of the Seller, The School Board of Broward County.
  • If The School Board of Broward County does not confirm top bid prices, items may be withdrawn from the auction and offered at another time at the discretion of the School Board of Broward County. All top bid prices are expected to be confirmed, and Top Bidders will be notified their bid has been accepted within 48 hours from the time the auction closes.
  • The Auctioneer reserves the right to establish minimum amounts for opening bids. If bidders do not comply with the minimum amounts stated, bids received that are less than those set forth will not be accepted.

5. PLACE

  • The National Auction Company will conduct the Auction, and information about the auction can be found on their website, www.natlauction.com. The auction platform of Proxibid will be used for this auction event.

6. INSPECTION OF VEHICLES

  • Vehicles, Trailers, and Equipment included in this auction are not available for Preview because they are located at restricted School Bus Terminals. Pre-event previews can be scheduled by appointment with the auctioneer and his staff. Those desiring to preview the auction inventory should contact George Richards to schedule (954-658-5033).
  • Potential bidders/purchasers will not be permitted to drive any vehicle before the auction. ALL VEHICLES, TRAILERS, AND EQUIPMENT ARE BEING OFFERED IN AS-IS CONDITION.
  • Information is provided for all assets scheduled for inclusion in this auction. Descriptions and photographs will be published on the Auctioneer’s website.
  • The information included on the Website includes videos of Vehicles that could be started. It is possible inventory described as “Non-Run” could be started and driven. However, at the time the auction materials were being gathered, those marked as Non-Run could not be started.
  • Most of the vehicles included in this auction have not been driven for an extended period of time. Many of the vehicles will not start on their own and may require new batteries or repairs. In addition, the condition of tires is unknown, and it is possible some of the vehicles cannot be safely driven long distances.
  • Every effort has been made to accurately illustrate and describe the condition of every School Bus, Vehicle, Trailer, and Equipment included in this auction. However, it is possible all defects were not observed. It is also possible between the time auction materials were being gathered and when Vehicles were picked up, charging levels in batteries could have changed. The fact auction materials state that a Vehicle could be started but will not start at the time it is being picked up will not be cause for any sale to be voided. Every effort will be made to assist as much as possible.
  • Potential bidders should be aware Vehicles shown in videos with engines running and being moved, may have been out of service for an extended period of time. Purchasers/Bidders should not assume Vehicles can be driven long distances. Purchasers/Bidders are encouraged to check fluid levels before attempting to drive them.
  • Many of the Vehicles included in this auction are exempt from odometer/mileage statements. Odometer readings/hour meter readings included as part of the vehicle information are as reported by the seller and might not be accurate. As possible, odometer readings stated in the auction materials have been verified. If actual odometer readings/hour meters are different from that reported in the auction information, it will not be a cause for the invalidation of the sale.
  • Each item included in this auction is specifically offered and sold in As-Is condition without guarantee or warranty, either expressed or implied.
  • Specific information not included on the website can possibly be obtained by contacting George Richards at (954) 658-5033. It is possible that the specific information requested may not be available.

7. CONDITIONS OF SALE AND DELIVERY

  • The School Board of Broward County, as a casual seller, is selling surplus School Buses, Vehicles, Trailers, and Equipment at Public Auction for cash to the highest bidders.
  • Announcements made by the Auctioneer will be sent as emails through the website and distributed to all registered bidders.
  • Despite efforts to avoid withdrawal of items from the sale list after being published and/or advertised, there could be circumstances when such action is necessary. The School Board of Broward County reserves the right to remove any item from the auction and reserves the right to accept or reject any/all bids.
  • All School Buses, Vehicles, Trailers, and Equipment are being offered and sold “as is” and “where is.” The School Board of Broward County and National Auction Company makes no warranties or guarantees, expressed or implied, regarding the operation or condition of any item included in the auction. Even though great effort has been made to ensure the accuracy of the information, it is possible that the information provided might not be correct.
  • Once top bid prices have been received and communicated to Broward County Personnel, all sales are final and not subject to any refunds or exchanges.
  • All successful bidders(s) agree to comply with all terms and provisions as listed above.

8. BUYER’S PREMIUM

  • A 7% Buyer’s Premium will be added to all top bid prices and included in the final purchase price.

9. NOTIFICATION TO TOP BIDDERS

  • All Top Bidders will be notified their bid has been accepted by the National Auction Company through the E-Mail address supplied at the time of Bidder Registration.
  • Payments can be made by Cash, Money Order, Certified Check, or Cashier’s Check. All checks should be payable to National Auction Company, Auctioneer’s Escrow Account. Personal and Corporate Checks will only be accepted when accompanied by a current bank letter that guarantees payment for purchases made at this auction.
  • Payments can also be made via Bank-to-Bank Wire Transfer. Please contact the Auctioneer for bank information.
  • CREDIT CARDS, DEBIT CARDS, or payment formats such as ZELLE WILL NOT BE ACCEPTED.

10. PAYMENTS

  • Payments will be accepted starting on January 26 and January 29 between 10:00 A.M. and 3:00 P.M.
  • All payments must be made at the Broward County Schools, Northwest Bus Terminal, which is located at 2600 NW 18 Terrace, Pompano Beach, Florida 33071. Please watch for Auction/Cashier Directional Signs. Signs will be posted directing purchasers to the area designated for use by the National Auction Company.
  • Payments can be made between 10:00 A.M. and 3:00 P.M. Payments made after January 29, 2024, may subject the Purchaser to a surcharge of 10% of the purchase price. Please plan to pay for purchased vehicles and other items by the date specified.

11. MOTOR VEHICLE TITLES

  • Motor Vehicle Certificates of Title and keys are ONLY available at the Northwest Bus Terminal (2600 NW 18 Terrace, Pompano Beach, Florida 33071).
  • If a Top Bidder has purchased more than one item, payment in full must be received before anything can be removed from County property.
  • Invoices will be in the name of Purchasers only and cannot be combined under other Bidder’s numbers as assigned by Proxibid.

12. SALES TAX

  • Florida Sales Tax will be calculated on the full purchase price, that is, the top bid price plus a 7% Buyer’s Premium.
  • National Auction Company does not collect sales tax on titled motor vehicles, which must be paid at the time of title transfer.
  • Dealers who purchase for resale must provide a copy of their 2024 resale certificate to the National Auction Company by e-mail to lori@natlauction.com. If this certificate is not provided, sales tax will be charged.
  • Sales Tax will be collected on any non-titled items.

13. MOTOR VEHICLE TITLE TRANSFERS

  • Purchasers are responsible for transferring Certificates of Title into their name or company name as listed on the Invoice provided by the National Auction Company. Transfer of title must be completed within 10 days of the date set forth on the Invoice provided by the National Auction Company.
  • Registration fees and Sales Tax must be paid at the time Certificates of Title are transferred.
  • All Certificates of Title will be closed to include the name of the Purchaser, their address, the date the vehicle was sold and purchase price.
  • Licensed Motor Vehicle dealers must provide a copy of their license and Sales Tax Resale Number at the time of bidder registration.
  • Open titles will not be given to purchasers.
  • Please review the information included on the Trailers included in this auction as many of them do not have Certificates of Title and may only have Vehicle Registrations or Manufacturer’s Statement of Origin.

14. DEFAULT

  • If a buyer fails to complete the sale under the conditions set forth or agreed to by The School Board of Broward County, any deposits and/or payments made to the account of the School Board will be forfeited and vehicles will remain the property of the School Board.
  • If a Top Bidder fails to make payment in full after being notified their bid has been accepted, at the discretion of The School Board of Broward County and/or the Auctioneer, the bidder’s name may be subject to removal from the mailing list and may not be permitted to participate in future auctions. Failure to make final payment may result in removal from future bidder registration (s) for other auctions conducted on the Proxibid platform.

15. REMOVAL

  • Vehicles, Trailers and Equipment must be removed from Broward County School Board Terminals on or before January 31, 2024. The School Board of Broward County and National Auction Company are not responsible for any vehicle (s) remaining at the auction site after completion of the auction.
  • It is recommended purchasers make contact with the Auctioneer to schedule times for removal from School Board property. Entry to any Terminal requires admittance with an Auction Staff member and photographic identification.
  • Entry times are restricted by operation schedules at Broward County School Board Terminals.
  • It will be the responsibility of Top Bidders (Purchasers) to arrange for their own transportation and removal of Non-Running Vehicles from School Board.
  • Bidders/Purchasers should be prepared to have Vehicles designated in auction materials as non runners towed. Tow trucks can only enter School Board Terminals when accompanied by Auction Staff members.
  • Top Bidders/Purchasers using Towing or Transport Services will be required to be present when their vehicles are being removed from Broward County School Board property. Please make sure contact information is provided to auction company personnel.
  • Top Bidders (Purchasers) will be required to sign a receipt that shows delivery of purchased Vehicles.
  • Repair work other than replacement of batteries is strictly prohibited at any Broward County School Board Property.

  • Each entrance is secured 24/7 and access requires photo identification. Copies of Purchaser Receipts and Bill of Sale should be made available for inspection by the security guard or School Board Staff.

17. REGISTRATION

  • All bidders are required to register with National Auction Company on their website, www.natlauction.com. To participate in the auction, all bidders must register with Proxibid.Com. Each Bidder will be assigned a Bidder’s Number and that number will be recorded for each sale.

18. AUTOMOTIVE SERVICE EQUIPMENT LOCATED AT PIPER SENIOR HIGH SCHOOL

  • This auction includes automotive service equipment located at Piper Senior High School, 8000 NW 44 Street, Sunrise, Florida 33351.
  • Purchasers of this equipment must remove it by appointment only which will be confirmed by Auction Staff and School Board Personnel.
  • Purchasers must bring their own tools and equipment required to remove the equipment from Broward School Board property.
  • Broward County Public Schools does not have a forklift at this location and purchasers must provide their own.
  • The Purchaser (s) of the automotive equipment will be required to (a) provide proof of necessary certification(s), licensure and adequate insurance, including, but not limited to, crane and rigging liability, general liability, workman’s compensation, automobile and liability; (b) at least two (2) business days prior to removal of the automotive equipment, supply a Certificate of Insurance naming Broward County Public Schools and National Auction Company as additional insureds under general liability and crane and rigging liability coverages; and ©) coverage must be in the minimum amount of $1,000,000.00 per occurrence; $2,000,000.00 aggregate Liability for general liability; $1,000,000.00 Workman’s Compensation and Physical Damage $1,000,000.00 and contain a requirement for 30-day advance written Notice of Cancellation.
  • If you or your company are not able to provide this insurance, please do not bid on this equipment. In the event a top bidder (s) do not provide the Insurance Certificate required, the bid (s) will not be accepted.

19. COLLUSION

  • Collusion is defined as an agreement among competitive bidders to raise, fix or otherwise maintain the price at which goods or services are sold.
  • Auctions are governed under the Sherman Act enacted in 1890. The Sherman Acts prohibits any agreement among competitors to fix prices, rig bids or engage in other anti competitive activity.
  • Violations of the Sherman Act may be considered to be a felony and punishable by fines established in the Act.
  • Bidders planning to participate in this auction should be aware violations that come to the attention of National Auction Company will be reported to Broward County School Board for action they determine to be appropriate.

20. DIRECTIONS TO AUCTION CASHIERING LOCATION

  • From I-95 (Broward County)
    Exit at Copans Road and continue West to NW 18 Terrace and turn right. Continue on NW 18 Terrace to the sign which identifies Broward County Schools, Northwest Terminal. Watch for directional signs to the Auction Office.
  • FROM the Turnpike (Broward County)
    Exit at Sample Road. After paying toll, continue to the traffic signal and right (east) and continue to Powerline Road. At Powerline Road, turn right and continue to Copans Road. Make a U-Turn and continue to NW 25 Place and turn right.
